Please read these Terms of Service ("Terms") carefully before using the Duskly app ("App").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Duskly is a sleep optimization app that helps you:

• Track your caffeine intake
• Optimize your evening routine
• Receive sleep hygiene tips
• Assess your sleep readiness

The App is intended for informational and wellness purposes only and does not replace medical advice.

3. Free and Premium Version

Free Version: Basic features of Duskly are available for free.

Premium Subscription: Advanced features are available through a paid subscription:

• Monthly subscription: CHF 5/month
• Annual subscription: CHF 30/year

Prices may vary by region and are displayed in the App Store.

4. Subscription and Payment

• Payment is processed through your Apple ID account.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription at any time in your Apple ID account settings.
• Upon cancellation, Premium access remains until the end of the paid period.
• Any unused portion of a free trial period is forfeited when purchasing a subscription.

5. Usage Rights

We grant you a limited, non-exclusive, non-transferable right to use the App for personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer the App
• Use the App for illegal purposes
• Attempt to bypass security measures

6. Intellectual Property

All rights to the App, including design, text, graphics, and code, are owned by Mike Stettler and protected by copyright laws.

7. Disclaimer

No Medical Advice: The App does not provide medical advice. For sleep disorders or health concerns, please consult a doctor.

No Warranty: The App is provided "as is." We do not guarantee that the App will function error-free or achieve specific results.

Limitation of Liability: To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the App.

8. Privacy

Your privacy is important to us. Please read our Privacy Policy to learn how we handle your data.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be announced in the App. Continued use of the App after such changes constitutes acceptance of the new Terms.

10. Termination

We may terminate your access to the App at any time without notice if you violate these Terms.

11. Governing Law

These Terms are governed by the laws of Switzerland. The place of jurisdiction is Switzerland.

12. Severability

If any provision of these Terms is found to be invalid, the remaining provisions shall remain unaffected.
